Welcome to DOS AI. These Terms of Service ("Terms") govern your access to and use of the DOS AI website, APIs, and related services (collectively, the "Services") provided by MetaDOS LLC, doing business as DOS AI ("DOS", "we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Account Registration

To access certain features of the Services, you must create an account. You agree to:

2. API Usage

2.1 API Keys

API keys are provided for your use only and must not be shared with third parties. You are responsible for all API calls made using your keys. We reserve the right to revoke API keys that are shared or misused.

2.2 Rate Limits

We may impose rate limits on API usage to ensure fair access and system stability. Exceeding rate limits may result in temporary or permanent restrictions on your account.

2.3 Acceptable Use

You agree not to use the Services to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content that infringes on intellectual property rights
• Generate spam, phishing content, or malware
• Generate content that exploits minors
• Attempt to bypass safety filters or content moderation
• Reverse engineer, decompile, or attempt to extract model weights
• Use automated means to scrape or collect data from our Services
• Resell or redistribute the Services without authorization
• Interfere with or disrupt the integrity or performance of the Services

3. Billing and Payment

3.1 Credits and Pricing

Access to the API requires purchasing credits. Credits are consumed based on token usage. Current pricing is available on our pricing page. We reserve the right to change pricing with 30 days' notice.

3.2 Payments

Payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for all purchases. All payments are non-refundable except as required by law or at our sole discretion.

3.3 Taxes

You are responsible for all applicable taxes. Prices displayed may not include taxes, which will be added at checkout where required.

4. Intellectual Property

4.1 Our Property

The Services, including all software, algorithms, models, documentation, and content provided by DOS, are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

4.2 Your Content

You retain ownership of the content you submit to the Services ("Input") and the content generated using the Services ("Output"). You are responsible for ensuring you have the necessary rights to use your Input.

4.3 License to Use Output

Subject to these Terms, you may use Output for any lawful purpose, including commercial purposes. You acknowledge that similar Output may be generated for other users.

5. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be error-free, that Output will be accurate or reliable, or that the Services will meet your requirements.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless DOS and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorney's fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights.

9. Termination

We may terminate or suspend your account and access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease. Unused credits are non-refundable upon termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.

12. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and DOS regarding the Services.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction.
